These Terms of Use ("Terms") govern your use of the aiheart mobile application ("App") provided by Aplexity Limited ("we," "our," or "us"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old (or 16 in the EEA) to use the App. If you are under the age of majority in your jurisdiction, you must have your parent or legal guardian's consent.
2. License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms and the Apple App Store's Licensed Application End User License Agreement (EULA).
3. Not a Medical Device — Health Disclaimer
aiheart is a wellness and informational app. It is not a medical device, and it does not provide medical advice, diagnosis, or treatment.
Pulse readings are estimated from your device camera using photoplethysmography and may be inaccurate. They must not be used for clinical decisions.
Blood pressure values are self-entered by you; the App does not measure blood pressure.
AI Chat responses, tips, and articles are for general informational purposes only.
Always consult a qualified healthcare professional for any medical concern. If you believe you are experiencing a medical emergency, call your local emergency services immediately.
You use the App's health-related features at your own risk. Do not delay, alter, or discontinue any medical care based on information from the App.
4. Subscriptions and Payments
The App offers auto-renewing subscriptions processed by Apple and managed via Adapty.
Payment is charged to your Apple ID at confirmation of purchase.
Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period.
Your account will be charged for renewal within 24 hours prior to the end of the current period at the price of the selected plan.
You can manage or cancel subscriptions at any time in your Apple ID account settings. Uninstalling the App does not cancel a subscription.
Prices, plan durations, and free-trial terms are displayed in the App prior to purchase and may vary by region and promotion.
Any unused portion of a free trial is forfeited when you purchase a subscription, where applicable.
Refunds are handled by Apple per Apple's refund policy.
5. AI Assistant Feature
The App includes an AI Assistant powered by the OpenAI API. Your AI requests, your wellness profile, and your most recent heart-rate readings are transmitted from your device to our backend at aiheart.applexitystreams.com and then forwarded to OpenAI, L.L.C. for the sole purpose of generating a response. See Section 3 of our Privacy Policy for the full data-flow description.
Consent before each AI request. Before any data is sent for AI processing, the App displays an "AI Data Processing" confirmation dialog with Cancel and Continue buttons. No data is transmitted unless you tap "Continue". If you tap "Cancel", the request is dropped, nothing is sent, and the same dialog is shown again on every subsequent AI request until you tap "Continue". You may withdraw consent at any time in Settings → AI Assistant.
Responses are generated by a third-party AI model and may be inaccurate, incomplete, outdated, or inappropriate. Do not rely on AI output for medical, legal, financial, or other professional advice.
You are responsible for the prompts you submit and for how you use AI output.
You must not submit: (a) sensitive personal data of yourself or others; (b) content that is illegal, infringing, harmful, harassing, hateful, sexually explicit involving minors, or that violates any law; (c) content that attempts to jailbreak, exploit, or abuse the AI system.
The pulse measurement feature requires camera access and a fingertip placed on the rear camera and flash.
Results depend on lighting, motion, skin contact, and device hardware and are approximate estimates only.
Do not use the feature while driving, operating machinery, or in any situation where distraction could be unsafe.
7. Acceptable Use
You agree not to:
Reverse engineer, decompile, or disassemble the App except as permitted by law;
Use the App to violate any law or third-party rights;
Interfere with the App's operation, servers, or networks;
Use automated means to access the App without our permission;
Resell, sublicense, or exploit the App commercially.
8. Intellectual Property
All rights in the App, including software, design, branding, text, and graphics, belong to Aplexity Limited or its licensors. These Terms do not transfer any intellectual property rights to you beyond the limited license granted in Section 2.
9. User Content
You retain ownership of the prompts, diary entries, and content you submit ("User Content"). You grant us a worldwide, royalty-free license to process User Content solely to operate the App (including transmission to the OpenAI API to generate responses). You represent that you have all necessary rights to the User Content you submit.
10. Third-Party Services
The App integrates with third-party services (OpenAI, Apple, Firebase/Google, AppsFlyer, Adapty). Your use of those services is governed by their respective terms and privacy policies. We are not responsible for third-party services.
11. Disclaimers
The App is provided "as is" and "as available," without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, medically accurate, or that AI outputs will be correct.
12. Limitation of Liability
To the maximum extent permitted by law, Aplexity Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or health outcomes, arising out of or relating to your use of the App. Our aggregate liability shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD $50.
13. Indemnification
You agree to indemnify and hold harmless Aplexity Limited from any claims, damages, or expenses arising from your misuse of the App or violation of these Terms.
14. Termination
We may suspend or terminate your access to the App at any time if you violate these Terms. You may stop using the App at any time by uninstalling it. Sections that by their nature should survive termination will survive (IP, disclaimers, limitation of liability, governing law).
15. Changes to the Terms
We may update these Terms from time to time. Material changes will be announced in the App or the App Store listing. Continued use after changes means you accept the updated Terms.
16. Governing Law
These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-laws principles. Disputes shall be resolved in the competent courts of Hong Kong SAR, unless mandatory local consumer laws require otherwise.
17. Apple-Specific Terms
These Terms are between you and Aplexity Limited, not Apple. Apple is not responsible for the App or its content.
Apple has no obligation to provide maintenance or support for the App.
In case of failure to conform to any applicable warranty, you may notify Apple; Apple's sole obligation (if any) will be to refund the purchase price.
Apple is not responsible for addressing any claims relating to the App or your use of it.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
